The Philosopher's Stone is an actual legend/item that people across the ages have tried to obtain, something like the Holy Grail or Excalibur, its also a metaphorical reference to the strives of mankind and his quest to be the perfect being.

So even if it was the main plot line for FullMetal or even the first Harry Potter book it was an actual object or myth, so I don't think it should be viewed as copyright material since it can be found in the writings of scholars since AD? I mean I could call it "Elixir of Life" and it'll still refs the Stone since it has many names in history.
